These Terms of Service (“Terms”) govern your access to and use of Genix CRM (the “Service”), operated by Genix Technology (“we”, “us” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
Genix CRM is a customer relationship management and marketing analytics platform that enables agencies to manage clients, projects, tasks, proposals and reports, and to connect third-party marketing platforms for unified reporting.
2. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and promptly notify us of any unauthorized use. Accounts are intended for business use by authorized personnel of your organization.
3. Acceptable Use
You agree not to:
- Use the Service for any unlawful, harmful or fraudulent purpose;
- Attempt to gain unauthorized access to the Service or its systems;
- Interfere with or disrupt the integrity or performance of the Service;
- Reverse engineer or copy any part of the Service except as permitted by law;
- Use the Service to violate the terms or policies of any connected third-party platform.
4. Third-Party Platforms
The Service integrates with third-party platforms, including Google and Meta services. Your use of those platforms through the Service is also subject to their respective terms and policies. You are responsible for ensuring you have the necessary rights and authorizations to connect any account or business profile, and for complying with all applicable platform requirements, including the Google API Services User Data Policy and Google Business Profile API policies.
5. Customer Data
You retain ownership of the data you submit to the Service. You grant us a limited license to host, process and display that data solely to provide the Service. Our handling of personal data is described in our Privacy Policy.
6. Intellectual Property
The Service, including its software, design and content, is owned by Genix Technology and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding except as necessary to use the Service.
7. Fees
Where the Service is provided under a paid plan, applicable fees, billing terms and any refund arrangements will be communicated to you separately. Fees are non-refundable except as required by law or expressly stated.
8. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure.
9. Limitation of Liability
To the maximum extent permitted by law, Genix Technology shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or data, arising from or related to your use of the Service.
10. Termination
We may suspend or terminate your access to the Service if you breach these Terms or if we are required to do so by law. You may stop using the Service at any time. Upon termination, provisions that by their nature should survive will remain in effect.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of India, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Vadodara, Gujarat, India.
